West USA Realty (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our website at westusa.net (the “Site”) to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512.
1. Reporting Copyright Infringement
If you believe that content appearing on our Site infringes your copyright, you may submit a written notice to our designated DMCA agent. To be valid under the DMCA, your notice must include all of the following:
A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
A description of the material you claim is infringing, with enough detail for us to locate it on our Site (for example, a specific URL or page title).
Your contact information, including your full name, mailing address, telephone number, and email address.
A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.
2. Where to Send Your Notice

We strongly recommend sending notices by email for the fastest response. Notices that do not comply with all requirements of 17 U.S.C. § 512(c)(3) may not receive a response.
3. Our Response to Valid Notices
Upon receiving a complete and valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content. We will also make a reasonable attempt to notify the user who posted the content, if applicable.
4. Counter-Notification
If you believe your content was removed in error or as a result of misidentification, you may submit a written counter-notification to our DMCA agent. To be valid, your counter-notification must include:
Your physical or electronic signature.
Identification of the material that was removed and the location where it appeared on the Site before it was removed.
A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
Your full name, mailing address, telephone number, and email address.
A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if your address is outside the United States, the U.S. District Court for the District of Arizona, and that you will accept service of process from the person who submitted the original DMCA notice.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content no sooner than ten and no later than fourteen business days following receipt, unless our DMCA agent first receives notice that the complainant has filed a court action seeking to restrain you from engaging in the infringing activity.
5. Repeat Infringer Policy
West USA Realty maintains a policy of terminating, in appropriate circumstances, the accounts or access privileges of users who are found to be repeat infringers of copyright. We reserve the right to make this determination at our sole discretion.
6. Real Estate Listing Content and MLS Data
Property listings, photographs, descriptions, and related data displayed on our Site may be sourced from the Arizona Regional Multiple Listing Service (ARMLS) or contributed by licensed agents and third-party vendors. If you believe any listing content infringes your copyright, please follow the notice procedure in Section 1 and clearly identify the specific listing or image in question.
West USA Realty does not claim ownership of MLS-sourced data. All MLS content is used pursuant to our membership agreement with ARMLS and applicable MLS rules.
7. Misrepresentation
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.
8. Changes to This Policy
We may update this DMCA Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this page.
